Many of the personal qualities that were instrumental in Mr. Kyle's success as a general counsel have made him particularly effective as a mediator. He has a thorough understanding of the intricacies of the litigation process, and the ability to understand varied and complex legal issues, yet is able to step back and get to the essence of the situation, blending the "legalities" with the practical business concerns. He is comfortable and adept at communicating with senior executives as well as all levels of employees. Based on his experience of being one step removed from the front line litigators, he is able to be open to and appreciate the nuances of the legal and business positions of both the plaintiff and defendant in any given action. During his tenure as general counsel, Mr. Kyle's experience of bringing numerous litigated matters to a positive resolution via mediation led him to pursue a career as a mediator. In preparing for and conducting mediations, Mr. Kyle takes a proactive approach. Prior to the mediation, he contacts counsel to explain how the mediation will be conducted, to explore any exchange of information or documents prior to the mediation which might make resolution more attainable, and to discuss any special circumstances such as client related issues. At the mediation, with the concurrence of counsel, the parties are encouraged to take an active role in the discussions. Usually, separate and confidential meetings with each side are taken during the session to explore settlement options. Mr. Kyle does not take a formal or directive approach, but rather fosters an environment where the parties and counsel are comfortable in being creative and exploring various options. Mr. Kyle has broad experience in litigated matters relating to various business and commercial issues, contracts, real estate and personal injury, and he has special expertise in the mediation of all types of employment matters. Due to his experience in the practice of preventative law as general counsel, he has an unbiased, balanced and open view of employment litigation from both the employee's and employer's perspective. This balanced and open approach has proven equally successful in his general business litigation mediation practice.
